PODCAST GUEST RELEASE FORM
THIS AGREEMENT is made on [Date], BETWEEN:
[Podcast Host/Producer Name], of [Podcast Host/Producer Address] (“Producer”);
AND
[Guest Name], of [Guest Address] (“Guest”).
WHEREAS
- The Producer is the creator and owner of the podcast titled “[Podcast Name]” (“Podcast”);
- The Guest has agreed to participate as a guest on an episode of the Podcast;
- The parties wish to set forth the terms and conditions of the Guest’s participation.
NOW, THEREFORE, in consideration of the mutual promises set forth herein, the parties agree as follows:
1. Grant of Rights
1.1 The Guest grants the Producer the irrevocable right to record, use, reproduce, edit, distribute, display, and publicly perform the Guest’s voice, likeness, image, name, and any statements made during the recording (“Recording”) in connection with the Podcast, in any media, worldwide, without limitation.
1.2 The Producer may use the Recording for promotional, advertising, and commercial purposes, including but not limited to podcast episodes, social media, websites, and marketing materials.
2. Ownership
2.1 The Producer shall own all rights, title, and interest in the Recording, including all copyrights and intellectual property rights.
2.2 The Guest waives any right to inspect or approve the finished product or any use of the Recording.
3. Compensation
3.1 The Guest acknowledges and agrees that participation is voluntary and that no compensation, royalties, or other payment will be due for the use of the Recording, unless otherwise agreed in writing.
4. Guest Representations and Warranties
4.1 The Guest represents and warrants that:
- They have the right and authority to enter into this agreement;
- Their participation will not infringe upon or violate any third-party rights;
- Any content provided by the Guest does not contain material that is defamatory, obscene, or unlawful.
5. Release and Waiver
5.1 The Guest releases, discharges, and holds harmless the Producer and its affiliates from any and all claims, demands, or causes of action arising out of the use of the Recording as permitted herein.
6. Confidentiality
6.1 The Producer agrees not to disclose any sensitive or confidential information shared off-record by the Guest without the Guest’s express written consent.
7. Term & Termination
7.1 This agreement is effective as of the date signed and shall remain in effect indefinitely with respect to the rights granted herein.
7.2 Either party may terminate this agreement with written notice prior to the recording. Termination after the recording does not affect rights already granted to the Producer.
8. Governing Law
8.1 This agreement shall be governed by and construed in accordance with the laws of [Governing Law State/Country].
9. Entire Agreement
9.1 This agreement constitutes the entire understanding between the parties and supersedes all prior agreements, whether written or oral, relating to the subject matter herein.
9.2 Any amendments must be made in writing and signed by both parties.
10. Notices
10.1 Any notices under this agreement shall be sent to the addresses listed above or to such other address as either party may designate in writing.
